By accessing or using EasyStore24's platform, website, APIs, and related services (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree to these Terms, do not use our Services.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By creating an account, you represent that the information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
EasyStore24 provides a hosted eCommerce platform that enables merchants to create and manage online stores, process payments, manage inventory, and sell products and services online. Our Services include the store builder and hosting infrastructure, payment processing integrations, AI-powered store optimization tools, analytics and reporting dashboards, APIs for custom development (on eligible plans), customer support, and marketplace integrations and third-party app connections.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice before making material changes that affect your store's functionality.
You are responsible for all activity that occurs under your account, maintaining the security of your login credentials, ensuring that your store complies with all applicable laws and regulations, providing accurate business and tax information, and promptly notifying us of any unauthorized access to your account. EasyStore24 is not liable for any loss or damage resulting from unauthorized use of your account.
Subscription fees are billed monthly or annually in advance based on your selected plan. All prices are in U.S. dollars unless otherwise stated. EasyStore24 charges zero platform transaction fees on all plans; however, third-party payment processor fees (e.g., Stripe, PayPal) still apply at their published rates.
We may change pricing with 30 days' advance notice. Price changes do not apply to the current billing period. If you do not agree to a price change, you may cancel your subscription before the next billing cycle. Refunds are handled on a case-by-case basis; annual plans may receive a prorated refund for unused months.
You agree not to use the Services to sell products or services that violate any applicable law or regulation; engage in fraud, money laundering, or other financial crimes; distribute malware, viruses, or any harmful code; infringe upon intellectual property rights of others; send unsolicited communications (spam); attempt to gain unauthorized access to our systems or other users' accounts; use automated tools to scrape, crawl, or overload the platform; or sell prohibited items including counterfeit goods, illegal substances, weapons, or items that violate export controls.
Violation of this section may result in immediate suspension or termination of your account without refund.
EasyStore24 retains all rights, title, and interest in the platform, including our software, branding, documentation, and AI models. You retain ownership of all content you upload, including product images, descriptions, and your store design customizations.
By uploading content to our platform, you grant EasyStore24 a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of providing the Services. This license terminates when you remove the content or close your account.
Our collection and use of personal information is governed by our Privacy Policy. As a merchant, you are responsible for your own privacy practices regarding your customers' data. You agree to comply with all applicable data protection laws, including GDPR where applicable. You must publish a privacy policy on your store that accurately describes your data practices.
EasyStore24 targets 99.99% uptime for all stores. Planned maintenance windows will be communicated at least 48 hours in advance. In the event of unscheduled downtime exceeding our SLA, Enterprise plan customers may be eligible for service credits as outlined in their Service Level Agreement. EasyStore24 is not responsible for downtime caused by third-party services, force majeure events, or your own code or integrations.
You may cancel your subscription at any time through your account dashboard. Upon cancellation, your store will remain accessible until the end of the current billing period. After that, your store will be deactivated but your data will be retained for 90 days, during which you can export your data or reactivate your account.
We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees when due, or engage in activity that poses a security risk to the platform or other users.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYSTORE24'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. EASYSTORE24 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST DATA.
You agree to indemnify and hold harmless EasyStore24, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, your store content, your customers' claims against you, or your violation of any third-party rights.
Any disputes arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in the State of Delaware. Either party may seek injunctive relief in any court of competent jurisdiction. Class action waiver: you agree to resolve disputes individually and waive any right to participate in a class action lawsuit.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal action must be filed within one year of the cause of action arising.
